A written agreement or contract conveys rights, interests, and obligations to each party to the contract. To be certain that you are protected, you should always make sure your agreement is in writing and signed by the other party or parties to the contract.

Verbal or oral agreements are not always enforceable and when they are, the only evidence of the actual agreement is usually the testimony of the parties and each party will have its own version of the terms of the agreement. A written agreement, on the other hand, speaks for itself and does not present the proof problems inherent in a verbal agreement. After all, the main reason for having a written contract is to protect one’s rights, if need be, in a court of law or other forum selected by the contracting parties in their agreement. A signed written contract is the best protection a business or individual can have if a breach occurs by the other party to the contract.
